FLY CREEK – The town of Otsego held their monthly board
meeting last Wednesday, where a resident’s dispute over the town’s land
use law was a topic of discussion.
Wayne D. Clinton, of Fly Creek, filed a complaint of alleged land
use law violations by his neighbors, Donald and Gail Olin, to the
town’s codes enforcement officer, Sal Furnari.
The complaint stems from the existence of a fifth-wheel mobile
camper, which is equipped with an above-ground sewage system and an
exposed electrical hook up, on Olin’s neighboring property. The
property is owned by Olin’s daughter and son-in-law Justin and Karli
Walsh. The Walshes are also in the process of building a home on
the property.
Clinton’s complaint cited a number of sections from the town’s land use law that Olin is allegedly violating.
Following Furnari’s review of Clinton’s complaint, he issued a
notice of violation to the Walshes. The nature of the violation stated
the Walshes’ noncompliance with the town’s land use law, stating,
“second principal building on lot, sewage disposal system not a
subsurface system, rather an alternative system, therefore requiring a
design prepared by a licensed engineer and approved by DOH (Department
of Health).”
The notice stated that an acceptable remedy to the problem would be
to close down the trailer and remove it from its current location, to
be remedied by Aug. 13.
“I want to help protect the historic and natural character of the
town, if this is allowed it opens the door for them (mobile campers) to
be parked everywhere,” said Clinton in regards to his motivation behind
the complaint.
The Olins, who were present at the meeting, said they were in the
process of appealing the notice with the Zoning Board of Appeals.
Donald Olin declined to comment following the meeting.
In other matters, following the recent death of town of Otsego
Trustee Leslie Weir, the town’s four-member board agreed to issue a
public announcement calling for applicants to take Weir’s seat until
the end of the year. The board said they would review applications and
hold private interviews prior to the August board meeting.
